Resolving a boundary dispute with your neighbor

After many years of saving, you’ve finally purchased your dream home. You’ve been there for several months now, and it’s everything that you had imagined. 

You took a short trip away with your family for a few days, and upon your return, you were shocked by what you found. Your next-door neighbor has erected a fence, and it has crossed over onto your garden. 

Instances like this are typically referred to as boundary disputes. What are your options in such a scenario? 

Try reasoning first 

It would be very easy to fly off the handle when faced with this prospect, but it’s not necessarily the best course of action. Your neighbor may have made an honest mistake in identifying the legal boundary of their property. It’s possible that they don’t want to enter into a dispute, and you can seek a prompt resolution. After a reasonable conversation, they may agree to have the workmen come back and remove the fence from your property, as well as cover the cost of any damage. 

Gather documentation 

If it’s looking like a reasonable settlement is off the table, it’s best to gather as much evidence as possible. Make sure you have your title deeds close to hand, and any other documentation relating to your property rights. You may also want to take pictures and video evidence, which could prove useful later on.
